not technical... aslong you name it somthig else and/or you give credit to owner and/or it's part of a leaning experince that's ok, but if just take a f-zero game and copy the code line for line then it copyright
for example the guy who recreated super mario maker (smm) that was illegal... but if you make a smm clone and don't use anything mario related and use your own sprites and/or sb's srites your fine
